Terms of Trade – Strength Metrics Limited

Kia ora! Thanks for choosing Strength Metrics Limited.

These Terms of Trade set out the agreement between you (our valued customer) and us (the supplier of our products). Please read them carefully. By placing an order with us, you agree to these Terms.

Definitions

We, us, our: Strength Metrics Limited and our team.
You: the customer purchasing our Products.
Products: the apparel and chalk we sell.
Order: your purchase request submitted via our website or any method we accept.
Order Price: the total amount payable for your Order, including GST and any delivery charges.

Ordering and Acceptance

Your Order is confirmed once we accept it, either by sending you a confirmation email or dispatching your Products.

We reserve the right to decline any Order for any reason, but we will always notify you if that happens.

Pricing and Payment

All prices are in New Zealand dollars (NZD) and include GST unless stated otherwise.

Payment must be made in full at the time you place your Order.

If a pricing error occurs, we will contact you before proceeding with your Order.

Delivery

We will deliver your Products to the address you provide.

Delivery timeframes are estimates only. While we aim to meet them, delays may occur outside our control.

Risk in the Products (including loss or damage) passes to you upon delivery.

Ownership

Ownership of the Products remains with us until full payment has been received.

Photo Usage Consent

We love showcasing our community. If you tag us on social media or submit photos to us, you grant us permission to use those images (with or without your name) for marketing purposes, including on our website, social media, and promotional materials.

If you prefer not to have your images used, simply email us at timmonigatti@strengthmetrics.com and we will respect your request.

Consumer Rights

Our Products come with guarantees that cannot be excluded under the Consumer Guarantees Act 1993.

If your Products are faulty or not as ordered, you are entitled to a repair, replacement, or refund under New Zealand law.

These guarantees apply to personal use purchases. If you are purchasing for business or resale, different rights may apply.

Returns and Exchanges

We want you to be satisfied with your purchase.

• Change-of-mind returns are eligible for exchange or store credit within 30 days, provided items are unused and in original condition.
• Faulty or incorrect items should be reported promptly so we can resolve the issue.

Warranty

Our Products are made to perform, but if something is not right, we will help.

We offer a 6-month warranty against defects in materials or workmanship, excluding normal wear and tear.

This warranty does not cover damage caused by misuse, abuse, accidents, or unauthorised alterations or repairs.

Liability

To the fullest extent permitted by New Zealand law, we are not liable for indirect or consequential losses (including loss of profit or opportunity).

If we are found liable, our maximum liability is limited to the Order Price paid for the Products.

Force Majeure

We are not liable for delays or failure to supply Products due to events beyond our control, including natural disasters, shipping disruptions, or pandemics.

Default and Cancellation

If you fail to pay or breach these Terms, we may cancel your Order or suspend delivery without notice.

We may also cancel an Order if we are unable to supply the Products. In such cases, you will receive a full refund.

Intellectual Property

All content on our website, including logos, images, product names, and designs, is owned by Strength Metrics Limited (or its licensors) and may not be used without permission.

Disputes

If any issues arise, we encourage you to contact us first so we can resolve the matter in good faith.

If a resolution cannot be reached, either party may refer the dispute to mediation under New Zealand law.

Changes to These Terms

We may update these Terms from time to time. The latest version will apply to all new Orders.
